Chapter 19: The moon's tilt and height
פרק יטThe last chapter answers two questions the court put to witnesses: which way the moon leaned, and how high it stood. For the first, the Rambam explains the tilt of the zodiac against the equator with a table, finds the moon's distance from the equator, and shows which way the crescent appears to lean. For the second, he relates the moon's height to the arc of sighting. He closes the laws with a verse from Isaiah.
אלְפִי שֶׁאָמְרוּ חֲכָמִים, שֶׁבִּכְלַל דְּבָרִים שֶׁהָיוּ בּוֹדְקִין בָּהֶן אֶת הָעֵדִים, אוֹמְרִין לָהֶן 'לְהֵיכָן הָיָה הַיָּרֵחַ נוֹטֶה?' - כָּשֵׁר בְּעֵינַי לְהוֹדִיעַ דֶּרֶךְ חֶשְׁבּוֹן דָּבָר זֶה. וְאֵין אֲנִי מְדַקְדֵּק בּוֹ, לְפִי שֶׁאֵינוֹ מוֹעִיל בָּרְאִיָּה כְּלָל. וּתְחִלַּת חֶשְׁבּוֹן זֶה, לֵידַע נְטִיַּת הַמַּזָּלוֹת תְּחִלָּה.
1The Sages said that among the questions used to examine the witnesses, they would ask them, "Which way was the moon tilted?" So I have seen fit to explain how this is calculated. I am not precise about it, since it does not help at all in determining the sighting. The calculation begins with knowing the tilt of the signs of the zodiac.
בהָעֲגֻלָּה שֶׁהִיא עוֹבֶרֶת בְּמַחֲצִית הַמַּזָּלוֹת שֶׁבָּהּ מְהַלֵּךְ הַשֶּׁמֶשׁ, אֵינָהּ עוֹבֶרֶת בְּאֶמְצַע הָעוֹלָם מֵחֲצִי הַמִּזְרָח לַחֲצִי הַמַּעְרָב, אֶלָא נוֹטָה הִיא מֵעַל הַקַּו הַשָּׁוֶה הַמְּסַבֵּב בְּאֶמְצַע הָעוֹלָם, כְּנֶגֶד צָפוֹן וְדָרוֹם - חֶצְיָהּ נוֹטָה לַצָּפוֹן וְחֶצְיָהּ נוֹטָה לַדָּרוֹם.
2The circle that passes through the middle of the zodiac, in which the sun travels, does not pass through the middle of the world from due east to due west. It is tilted from the equator, the line that runs around the middle of the world, toward the north and the south: half of it tilts to the north and half to the south.
גוּשְׁתֵּי נְקֻדּוֹת יֵשׁ בָּהּ שֶׁפּוֹגַעַת בָּהֶן בַּעֲגֻלַּת הַקַּו הַשָּׁוֶה הַמְּסַבֵּב בְּאֶמְצַע הָעוֹלָם - הַנְּקֻדָּה הָאַחַת רֹאשׁ מַזַּל טָלֶה, וְהַנְּקֻדָּה הַשְּׁנִיָּה שֶׁכְּנֶגְדָּהּ רֹאשׁ מַזַּל מֹאזְנַיִם. וְנִמְצְאוּ שִׁשָּׁה מַזָּלוֹת נוֹטוֹת לַצָּפוֹן, מִתְּחִלַּת טָלֶה עַד סוֹף בְּתוּלָה; וְשִׁשָּׁה נוֹטוֹת לַדָּרוֹם, מִתְּחִלַּת מַזַּל מֹאזְנַיִם עַד סוֹף מַזַּל דָּגִים.
3It has two points where it meets the circle of the equator that runs around the middle of the world. One point is the head of Aries, and the second point, opposite it, is the head of Libra. So six signs tilt to the north, from the beginning of Aries to the end of Virgo, and six tilt to the south, from the beginning of Libra to the end of Pisces.
דוּמֵרֹאשׁ מַזַּל טָלֶה יַתְחִילוּ הַמַּזָּלוֹת לִנְטוֹת מְעַט מְעַט, וּלְהִתְרַחֵק מֵעַל הַקַּו הַשָּׁוֶה כְּנֶגֶד הַצָּפוֹן עַד רֹאשׁ סַרְטָן, וְיִהְיֶה רֹאשׁ סַרְטָן רָחוֹק מֵעַל הַקַּו הַשָּׁוֶה לְרוּחַ צָפוֹן, שָׁלוֹשׁ וְעֶשְׂרִים מַעֲלוֹת וַחֲצִי מַעֲלָה בְּקֵרוּב. וְיַחְזְרוּ הַמַּזָּלוֹת לְהִתְקָרֵב לְקַּו הַשָּׁוֶה מְעַט מְעַט, עַד רֹאשׁ מֹאזְנַיִם שֶׁהוּא עַל הַקַּו הַשָּׁוֶה. וּמֵרֹאשׁ מֹאזְנַיִם יַתְחִילוּ לִנְטוֹת וּלְהִתְרַחֵק כְּנֶגֶד רוּחַ דָּרוֹם, עַד רֹאשׁ גְּדִי, וְיִהְיֶה רֹאשׁ גְּדִי רָחוֹק מֵעַל הַקַּו הַשָּׁוֶה לְרוּחַ דָּרוֹם, שָׁלוֹשׁ וְעֶשְׂרִים מַעֲלוֹת וַחֲצִי מַעֲלָה. וְיַחְזְרוּ הַמַּזָּלוֹת לְהִתְקָרֵב מְעַט מְעַט כְּנֶגֶד הַקַּו הַשָּׁוֶה, עַד רֹאשׁ טָלֶה.
4From the head of Aries the signs begin to tilt little by little, moving away from the equator toward the north, until the head of Cancer. The head of Cancer is about 23½° north of the equator. Then the signs come back closer to the equator little by little, until the head of Libra, which is on the equator. From the head of Libra they begin to tilt and move away toward the south, until the head of Capricorn. The head of Capricorn is 23½° south of the equator. Then the signs come back closer to the equator little by little, until the head of Aries.
הנִמְצָא רֹאשׁ טָלֶה וְרֹאשׁ מֹאזְנַיִם, מְסַבֵּב עַל הַקַּו הַשָּׁוֶה. וּלְפִיכָךְ כְּשֶׁתִּהְיֶה הַשֶּׁמֶשׁ בִּשְׁנֵי רָאשִׁים אֵלּוּ, לֹא תִהְיֶה נוֹטָה לֹא לַצָּפוֹן וְלֹא לַדָּרוֹם, וְתִזְרַח מֵחֲצִי מִזְרָח וְתִשְׁקַע בַּחֲצִי מַעֲרָב, וְיִהְיֶה הַיּוֹם וְהַלַּיְלָה שָׁוִין בְּכָל הַיִּשּׁוּב.
5So the head of Aries and the head of Libra lie on the equator. That is why, when the sun is at these two heads, it tilts neither north nor south: it rises due east and sets due west, and day and night are equal throughout the inhabited world.
והֲרֵי נִתְבָּרֵר לְךָ שֶׁכָּל מַעֲלָה וּמַעֲלָה מִמַּעֲלוֹת הַמַּזָּלוֹת נוֹטָה לַצָּפוֹן אוֹ לַדָּרוֹם, וְיֵשׁ לִנְטִיָּתָהּ שִׁעוּר; וְרֹחַב הַנְּטִיָּה, לֹא תִהְיֶה יוֹתֵר עַל שָׁלוֹשׁ וְעֶשְׂרִים מַעֲלוֹת וְחֵצִי בְּקֵרוּב.
6So it is clear to you that every degree of the zodiac tilts north or south by a certain amount, and the width of the tilt is never more than about 23½°.

7These are the amounts of the tilt according to the number of degrees along the zodiac, counting from the beginning of Aries:

חוְאִם יִהְיוּ אֲחָדִים בַּמִּנְיָן, תִּקַּח לָהֶם מְנָתָם מִבֵּין שְׁתֵּי הַנְּטִיּוֹת, כְּמוֹ שֶׁבֵּאַרְנוּ בַּשֶּׁמֶשׁ וּבַיָּרֵחַ.
8If the number has units, take their share between the two tilts, as we explained for the sun and the moon.
כֵּיצַד? חָמֵשׁ מַעֲלוֹת, נְטִיָּתָם שְׁתֵּי מַעֲלוֹת; וְאִם הָיָה מִנְיַן הַמַּעֲלוֹת שָׁלוֹשׁ וְעֶשְׂרִים, נְטִיָּתָם תֵּשַׁע מַעֲלוֹת.
For example: 5° has a tilt of 2°, and if the number of degrees is 23, its tilt is 9°.
וְעַל דֶּרֶךְ זוֹ, בְּכָל הָאֲחָדִים שֶׁעִם הָעֲשָׂרוֹת.
Do the same with all units that come with the tens.
טוּמֵאַחַר שֶׁתֵּדַע הַנְּטִיָּה שֶׁל מַעֲלוֹת מֵאַחַת עַד תִּשְׁעִים, תֵּדַע נְטִיַּת כֻּלָּן כְּדֶרֶךְ שֶׁהוֹדַעְנוּךָ בְּרֹחַב הַיָּרֵחַ.
9Once you know the tilt of the degrees from 1 to 90, you know the tilt of all of them, in the way we taught you for the moon's latitude.
שֶׁאִם הָיָה הַמִּנְיָן יוֹתֵר עַל תִּשְׁעִים עַד מֵאָה וּשְׁמוֹנִים, תִּגְרַע אוֹתוֹ מִמֵּאָה וּשְׁמוֹנִים; וְאִם הָיָה יוֹתֵר עַל מֵאָה וּשְׁמוֹנִים עַד מָאתַיִם וְשִׁבְעִים, תִּגְרַע מִמֶּנּוּ מֵאָה וּשְׁמוֹנִים; וְאִם הָיָה יוֹתֵר עַל מָאתַיִם וְשִׁבְעִים עַד שְׁלוֹשׁ מֵאוֹת וְשִׁשִּׁים, תִּגְרַע אוֹתוֹ מִשְּׁלוֹשׁ מֵאוֹת וְשִׁשִּׁים.
If the number is more than 90, up to 180, subtract it from 180. If it is more than 180, up to 270, subtract 180 from it. If it is more than 270, up to 360, subtract it from 360.
וְהַנִּשְׁאָר, תֵּדַע נְטִיָּתוֹ, וְהוּא נְטִיַּת אוֹתוֹ הַמִּנְיָן שֶׁבְּיָדְךָ, בְּלֹא גֵּרָעוֹן וְלֹא תוֹסֶפֶת.
Find the tilt of what remains; that is the tilt of the number you have, with nothing subtracted and nothing added.

10If you want to know how many degrees the moon is inclined from the equator toward the north or toward the south of the world, first find the tilt of the degree that is the moon's true position, and in which direction it tilts, north or south. Then calculate the moon's first latitude and see whether it is northern or southern. If the moon's latitude and the tilt of its degree are in the same direction, for example both northern or both southern, add them together. If they are in two directions, for example one southern and one northern, subtract the smaller from the larger. The remainder is the moon's distance from the equator, in the direction of the larger of the two.
יאכֵּיצַד? בָּאנוּ לֵידַע כַּמָּה הַיָּרֵחַ נוֹטֶה מֵעַל הַקַּו הַשָּׁוֶה בְּלֵיל הָרְאִיָּה שֶׁהוּא שֵׁנִי לְחֹדֶשׁ אִיָּר מִשָּׁנָה זוֹ - וּכְבָר יָדַעְתָּ שֶׁמַּעֲלַת הַיָּרֵחַ הָיְתָה תְּשַׁע עֶשְׂרֵה מִמַּזַּל שׁוֹר, נְטִיָּתָהּ בַּצָּפוֹן כְּמוֹ שְׁמוֹנֶה עֶשְׂרֵה מַעֲלוֹת, וְרֹחַב הַיָּרֵחַ הָיָה בַּדָּרוֹם כְּמוֹ אַרְבַּע מַעֲלוֹת, תִּגְרַע הַמְּעַט מִן הָרַב, יִשָּׁאֵר אַרְבַּע עֶשְׂרֵה מַעֲלוֹת. וְנִמְצָא הַיָּרֵחַ רָחוֹק מֵעַל הַקַּו הַשָּׁוֶה אַרְבַּע עֶשְׂרֵה מַעֲלוֹת לְרוּחַ צָפוֹן, שֶׁהֲרֵי הַמִּנְיָן הָרַב שֶׁהוּא שְׁמוֹנֶה עֶשְׂרֵה מַעֲלוֹת הָיָה צְפוֹנִי.
11For example: we come to find how far the moon is inclined from the equator on the night of sighting, the second of Iyar of this year. You already know that the moon's degree was the nineteenth of Taurus, whose tilt is about 18° to the north, and the moon's latitude was about 4° to the south. Subtract the smaller from the larger, and 14° remain. So the moon is 14° north of the equator, since the larger number, 18°, was northern.
וְכָל חֶשְׁבּוֹן זֶה בְּקֵרוּב בְּלֹא דִּקְדּוּק, לְפִי שֶׁאֵינוֹ מוֹעִיל בָּרְאִיָּה.
This whole calculation is approximate, not precise, since it does not help in determining the sighting.
יבאִם תִּרְצֶה לֵידַע לְאֵיזוֹ רוּחַ מֵרוּחוֹת הָעוֹלָם יֵרָאֶה הַיָּרֵחַ נוֹטֶה, תְּחַשֵּׁב וְתֵדַע מֶרְחָקוֹ מֵעַל הַקַּו הַשָּׁוֶה: אִם יִהְיֶה עַל הַקַּו הַשָּׁוֶה אוֹ קָרוֹב מִמֶּנּוּ בִּשְׁתַּיִם שָׁלוֹשׁ מַעֲלוֹת, בַּצָּפוֹן אוֹ בַּדָּרוֹם - יֵרָאֶה מְכֻוָּן כְּנֶגֶד אֶמְצַע מַעֲרָב, וְתֵרָאֶה פְּגִימָתוֹ מְכֻוֶּנֶת כְּנֶגֶד מִזְרַח הָעוֹלָם בְּשָׁוֶה.
12If you want to know toward which direction of the world the moon will be seen to tilt, calculate its distance from the equator. If it is on the equator, or within two or three degrees of it to the north or south, it will be seen straight toward due west, and its hollow [the concave side of the crescent] will be seen facing exactly toward the east.
יגוְאִם יִהְיֶה רָחוֹק מֵעַל הַקַּו הַשָּׁוֶה לִצְפוֹן הָעוֹלָם - יֵרָאֶה בֵּין מַעֲרַב הָעוֹלָם וּבֵין צְפוֹנוֹ, וְתֵרָאֶה פְּגִימָתוֹ נוֹטָה מִכְּנֶגֶד מִזְרַח הָעוֹלָם כְּנֶגֶד דְּרוֹם הָעוֹלָם.
13If it is far from the equator toward the north of the world, it will be seen between the west and the north of the world, and its hollow will be seen turned away from the east toward the south of the world.
ידוְאִם הָיָה רָחוֹק מֵעַל הַקַּו הַשָּׁוֶה לִדְרוֹם הָעוֹלָם - יֵרָאֶה בֵּין מַעֲרַב הָעוֹלָם וּבֵין דְּרוֹמוֹ, וְתֵרָאֶה פְּגִימָתוֹ נוֹטָה מִכְּנֶגֶד מִזְרַח הָעוֹלָם כְּנֶגֶד צְפוֹן הָעוֹלָם. וּלְפִי רֹב הַמֶּרְחָק, וּלְפִי רֹב הַנְּטִיָּה.
14If it is far from the equator toward the south of the world, it will be seen between the west and the south of the world, and its hollow will be seen turned away from the east toward the north of the world. The greater the distance, the greater the tilt.
טווּמֵחֲקִירַת הָעֵדִים, שֶׁאוֹמְרִין לָהֶם 'כַּמָּה הָיָה גָּבוֹהַּ'? וְדָבָר זֶה יִוָּדַע מִקֶּשֶׁת הָרְאִיָּה - שֶׁבִּזְמַן שֶׁתִּהְיֶה קֶשֶׁת הָרְאִיָּה קְצָרָה, יֵרָאֶה הַיָּרֵחַ כְּאִלּוּ הוּא קָרוֹב מִן הָאָרֶץ, וּבִזְמָן שֶׁתִּהְיֶה אֲרוּכָה, יֵרָאֶה גָּבוֹהַּ מֵעַל הָאָרֶץ. וּלְפִי אֹרֶךְ קֶשֶׁת הָרְאִיָּה, לְפִי גָּבְהוֹ מֵעַל הָאָרֶץ בִּרְאִיַּת הָעֵינַיִם.
15Among the questions put to the witnesses, they ask them, "How high was it?" This is known from the arc of sighting. When the arc of sighting is short, the moon appears close to the ground, and when it is long, it appears high above the ground. The longer the arc of sighting, the higher it appears above the ground to the eye.
טזהֲרֵי בֵּאַרְנוּ חֶשְׁבּוֹנוֹת כָּל הַדְּרָכִים שֶׁצְּרִיכִין לָהֶם בִּידִיעַת הָרְאִיָּה, וּבַחֲקִירַת הָעֵדִים, כְּדֵי שֶׁיִּהְיֶה הַכֹּל יָדוּעַ לַמְּבִינִים, וְלֹא יַחְסְרוּ דֶרֶךְ מִדַּרְכֵי הַתּוֹרָה וְלֹא יְשׁוֹטְטוּ לְבַקֵּשׁ אַחֲרֶיהָ בִּסְפָרִים אֲחֵרִים. "דִּרְשׁוּ מֵעַל סֵפֶר ה' וּקְרָאוּ אַחַת מֵהֵנָּה לֹא נֶעְדָּרָה" (ישעיהו לד, טז).
16We have now explained the calculations of all the methods needed for determining the sighting and for examining the witnesses, so that everything will be known to those who understand, and they will not lack any of the ways of the Torah, nor wander about looking for it in other books. "Search in the book of God and read: not one of these is missing" (Isaiah 34:16).
